Terms of Service

1. Overview

These Terms of Service ("Terms") form a legally binding agreement between BENIFITY INC. ("we," "our," or "us") and every individual or entity ("Users" or "you") who accesses or uses our website at https://rebeccaklepic.com, or any related website, application, or platform we operate (collectively, the "Website"), or who purchases our services.

By using our Website or services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Website or services.

Eligibility. You must be at least 18 years old (the age of majority in Alberta) and able to enter into a binding contract to purchase our services.

3. Professional Advice Disclaimer

Our services — including Human Design readings, Coaching, Hypnosis, and AI & Systems Coaching — are provided for education, personal growth, and empowerment only. They are not medical, psychological, legal, or financial advice.

Health & wellness. Hypnosis and coaching are complementary approaches. They are not intended to diagnose, treat, cure, or prevent any disease. If you are pregnant, breastfeeding, managing a medical or mental-health condition, or taking medication, consult your healthcare provider before engaging our services. You accept responsibility for your physical and emotional well-being during and after sessions.

Results. We make no guarantees about outcomes or results. Your progress depends on your own commitment, circumstances, and application of what is offered. Testimonials and client stories reflect individual experiences only; results vary and are not guaranteed.

4. Use of Third-Party Applications and AI Tools

To provide our services, we use trusted third-party applications, including but not limited to Google Workspace (secure storage; data may be stored outside Canada, including on U.S. servers), Airtable (client management), Zoom (virtual meetings), and Stripe and PayPal (payments).

AI tools we use:

AI use involving your personal information. Two of our AI uses involve your personal information: birth-time rectification, and audio recording and enhancement through Descript. For birth-time rectification:

Audio recording and enhancement (Descript). We use Descript to record the Human Design readings we send to you and to enhance the audio of client session recordings. These recordings include your voice and what is discussed, which may be sensitive. Descript is a U.S.-based service and may process or store audio outside Canada; where available, we use settings intended to limit retention and to exclude your content from training its AI models, and Descript's own terms apply to the audio it processes. Recordings follow the deletion timeline in Section 8 and our Privacy Policy — available to download for six (6) weeks, then removed. See our Privacy Policy for full details.

AI Coaching. AI Coaching is an educational service in which we teach you how to use AI tools to save time in your own work. We do not input your personal information as part of AI Coaching. You are solely responsible for any information you choose to enter into AI tools, and we recommend that you not input personal, sensitive, or confidential information you would not want shared online. AI outputs may be inaccurate; you are responsible for reviewing and verifying anything you rely on.

5. Data Collection, Storage, and Security

We collect and store personal information in accordance with Canadian law, including Alberta's Personal Information Protection Act (PIPA) and, where applicable, Canada's PIPEDA.

6. Cookies and Tracking

Our Website uses cookies and similar technologies for essential functions, analytics, advertising, and service improvement. Where required, we ask for your consent before using non-essential cookies. You can also manage cookies through your browser settings. Full details are in the Cookies section of our Privacy Policy.

7. Payments

Payments are processed through trusted third-party providers, currently Stripe and PayPal. Please review and agree to those providers' terms before purchasing. Applicable taxes may apply depending on your jurisdiction.

8. Refund & Cancellation Policy

We value your commitment to personal growth, and we recognize that circumstances change. This section explains how cancellations and refunds are handled.

Your consumer rights come first. Nothing in this Refund & Cancellation Policy limits or waives any non-waivable right you have under Alberta's Consumer Protection Act or other applicable law. Where that Act gives you a right to cancel and receive a refund (for example, for certain internet or prepaid purchases), that right applies despite anything below, and any required refund will be made within the timeframe the law requires.

9. Termination

You may stop using our Website and services at any time. We may suspend or terminate access if you violate these Terms.

10. Limitation of Liability

To the fullest extent permitted by law:

Nothing in this section limits or excludes any right, warranty, or remedy you have under Alberta's Consumer Protection Act or other applicable consumer protection law that cannot lawfully be limited or excluded.

11. Indemnification

You agree to indemnify and hold harmless BENIFITY INC., its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of our Website or services, or your violation of these Terms — except to the extent caused by our own negligence or wilful misconduct.

12. Security and User Responsibility

You are responsible for keeping any account details (including passwords) secure. If you suspect unauthorized access, notify us immediately. We will investigate security incidents but are not responsible for unauthorized use of your account that results from your failure to keep your credentials secure.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply in Alberta.

Arbitration (optional, your choice). If a dispute cannot be resolved informally, you and BENIFITY INC. may agree to resolve it by private, confidential, binding arbitration in Alberta. Consistent with Alberta's Consumer Protection Act, if you are a consumer you are not required to arbitrate: after a dispute has arisen, you may choose whether to resolve it through arbitration or through the courts, and nothing in these Terms prevents you from pursuing your rights in court or limits any right you have to participate in a class proceeding where the law allows.

14. Changes to These Terms

We may update these Terms as our practices or the law change. Material changes will be posted on our Website, and the "Last Updated" date above will be revised. Continued use of our Website or services after an update means you accept the revised Terms.
